1. Acceptance of Terms

By accessing or using the Éclat website and services, you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.

2. Services

Éclat provides digital services including KRA filing assistance, website development, graphic design, marketing, professional writing, business automation, and online education. All services are subject to availability and separate service agreements where applicable.

3. Payments & Refunds

• Payments are required before or at the start of service delivery as agreed.
• For KRA services: full payment required upfront. Refunds if filing cannot be completed.
• For design/web projects: 50% deposit, 50% on delivery. Deposits are non-refundable once work begins.
• For courses: fees are non-refundable after the first class. Transfer to another intake is available within 14 days of enrolment.
• We accept M-Pesa, bank transfer, and other agreed payment methods.

4. Client Responsibilities

• You agree to provide accurate and complete information required for your service.
• For KRA services: you confirm you are authorised to file the tax return in question.
• You agree not to use our services for any unlawful purpose.
• Timely provision of required materials (content, images, credentials) is your responsibility; delays may affect delivery timelines.

5. Intellectual Property

All original designs, code, and content created by Éclat for your project become your property upon final payment. Éclat retains the right to display completed work in our portfolio unless otherwise agreed in writing.

6. Confidentiality

We treat all client information, credentials, and business data as strictly confidential. We do not share client information with third parties without explicit consent.

7. Limitation of Liability

Éclat's liability for any service is limited to the amount paid for that specific service. We are not liable for any indirect, consequential, or incidental damages arising from the use of our services.

8. Amendments

We reserve the right to update these terms at any time. Continued use of our services constitutes acceptance of any revised terms.

9. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved under Kenyan jurisdiction.
